Tampa, FL - A Tampa family has filed a lawsuit claiming that inadequate safety measures at RiverTree Landing Apartments contributed to a shooting that left 26-year-old Erinique Moore with a life-threatening head injury.

Moore was attending a pajama birthday party on September 19, 2025, when uninvited individuals entered the property and an argument began.

Court documents state that defendant Lamonte Scott allegedly arrived at the apartment, demanded that people inside come out to fight and returned after deputies temporarily left the scene.

According to prosecutors, a witness reported seeing Scott through the peephole holding a firearm and threatening the individuals inside.

When two partygoers opened the door, a struggle started, and after the door shut, Scott allegedly ran off the porch and fired multiple shots into the apartment through a bedroom window.

One woman was grazed by a round, and Moore was struck in the forehead.

She was transported to Tampa General Hospital and has since required extensive rehabilitation to relearn basic functions.

Investigators say both a witness and Scott’s domestic partner identified him as the shooter.

Scott, who has prior felony convictions including a 2024 burglary, was charged with attempted second degree murder and aggravated battery.

Moore’s family and attorneys are suing RiverTree Landing Apartments and ZRS Management, alleging the complex had no access control, security personnel or surveillance despite repeated criminal incidents at or near the property.

They argue that proper security measures could have deterred the individuals involved and prevented the shooting.
